General Terms and Conditions for Sellers / Organisers
123event – Ticketing Platform

Article 1 – Definitions
For the purposes of these General Terms and Conditions, the following definitions apply:
123event
The online ticketing platform offered via the website www.123event.eu, which enables organisers to sell tickets for events.
Platform
The website, software, applications and systems provided by 123event for creating, managing and selling tickets.
Seller / Organiser
The natural person or legal entity that sells tickets for an event through the platform.
Buyer / User
The natural person or legal entity that purchases a ticket through the platform.
Ticket
The digital proof of admission to an event sold through the platform.
Event
Any activity for which tickets are sold through the platform.
Agreement
The agreement between 123event and the seller concerning the use of the platform.
Payment Provider
The external payment service provider that processes payments.
Article 2 – Applicability
These General Terms and Conditions apply to all services provided by 123event to sellers.
By using the platform, the seller declares that they have read and accepted these terms and conditions.
Any deviations from these terms and conditions are only valid if confirmed in writing by 123event.
The seller's own general terms and conditions do not apply unless expressly agreed upon in writing.
Article 3 – Registration and Account
To use the platform, the seller must create an account.
The seller is responsible for providing all requested information correctly and completely.
The seller guarantees that: the information provided is correct and complete; they are authorised to organise the event; all legal obligations are complied with.
123event reserves the right to refuse, block or delete accounts when: incorrect information is provided; fraud or misuse is suspected; applicable laws or these terms and conditions are violated.
Article 4 – Use of the Platform
The platform enables sellers to: create events; sell tickets; manage ticket categories; view sales statistics; manage communication with buyers.
123event acts exclusively as a technology platform and intermediary.
The agreement relating to participation in an event is concluded exclusively between the seller and the buyer.
123event is not an organiser of events and accepts no responsibility for the organisation or execution of events.
Article 5 – Seller's Responsibility
The seller is fully responsible for: the organisation and execution of the event; the content of the event page; ticket prices; compliance with applicable laws; permits and insurance; communication with buyers.
The seller shall indemnify and hold 123event harmless against all claims made by buyers or third parties arising from the event.
Article 6 – Ticket Sales and Prices
The seller determines: ticket prices; ticket categories; maximum capacity.
The seller is responsible for providing correct and transparent pricing information.
All prices must be displayed clearly, including any mandatory charges.
Article 7 – Payments and Payouts
Payments for tickets are processed through external payment service providers.
123event may charge service fees, transaction fees or platform fees.
These fees may be automatically deducted from the ticket revenues received.
Payouts to sellers are, in principle, made weekly, based on the tickets sold.
The final settlement for an event takes place during the first week following the end of the event, taking into account any corrections, refunds or fees.
123event reserves the right to temporarily suspend payouts in the event of a fraud investigation, disputes or irregularities.
Article 8 – Refunds and Reimbursements
The decision to grant a refund to a buyer lies entirely with the seller.
123event acts exclusively as a technical platform for processing ticket sales and refunds and is not a party to the decision whether or not to grant a refund.
Refunds may only be processed through the 123event platform and may not be processed outside the platform.
If a seller decides to grant a full or partial refund, the refund will be processed through the platform.
The seller acknowledges and accepts that: the original payment processing fees are not refunded by the payment provider; these fees remain payable by the seller; additional processing fees may be charged for the refund transaction.
All costs associated with both the original payment and the refund are fully charged to the seller.
123event cannot be held liable for any additional costs resulting from refunds.
Article 9 – Ticket Reservation (Hold Function)
The 123event platform uses a temporary ticket reservation function.
When a buyer selects tickets, these tickets may be automatically reserved for a limited period to allow the buyer to complete the payment.
If the payment is not completed within the specified period, the reserved tickets are automatically made available for sale again.
123event cannot be held liable for missed sales resulting from this reservation period.
Article 10 – Ticket Fraud and Duplication
Tickets contain a unique identification code or QR code.
Each ticket code can be validly scanned only once for admission to the event.
If a ticket is copied, forwarded or duplicated, only one copy can provide access to the event.
123event cannot be held liable for damages resulting from: ticket fraud; duplication of tickets; unauthorised resale of tickets; use of counterfeit tickets.
Article 11 – Ticket Scanning
The platform may provide scanning tools for checking tickets.
These tools are provided as an aid to organisers.
The seller remains responsible for: access control; staff responsible for checking tickets; correct use of the scanning tools.
Article 12 – Misuse of the Platform
It is prohibited to use the platform for: fraudulent activities; illegal events; misleading information; circumventing platform fees.
In the event of misuse, 123event may: block events; stop ticket sales; delete accounts.
Article 13 – Suspension of Payouts
123event may temporarily suspend payouts where there are indications of: fraud; misuse of the platform; disputes with buyers; irregularities in ticket sales.
Payouts will resume once the investigation has been completed.
Article 14 – Cancellation or Modification of Events
If an event is cancelled or significantly modified, the seller is responsible for: communication with buyers; refunds; any compensation.
123event is not responsible for the organisation or cancellation of events.
Article 15 – Event Policy and Reputational Damage
123event reserves the right to refuse, block or remove events if they: violate applicable laws; may result in fraud; may cause reputational damage to the platform; contain misleading or inappropriate content.
In such cases, 123event may stop ticket sales and suspend accounts.
Article 16 – Platform Availability
123event aims to ensure the highest possible availability of the platform.
Due to the nature of internet services, absolute availability cannot be guaranteed.
The platform may be temporarily unavailable due to maintenance, technical failures or external factors.
Article 17 – Liability
123event is not liable for damages resulting from: cancellation of events; organisational problems; incorrect information provided by sellers; misuse of tickets.
123event's liability is limited to a maximum of the amount of platform fees paid for the event concerned.
123event is not liable for indirect damages such as loss of profits or reputational damage.
Article 18 – Force Majeure
123event is not liable for failure to fulfil its obligations where such failure results from force majeure.
Force majeure includes, but is not limited to: internet outages; server problems; cyberattacks; power outages; government measures.
Article 19 – Intellectual Property
All intellectual property rights relating to the platform remain the property of 123event.
Article 20 – Termination
123event may terminate an account in the event of fraud, misuse or violation of these terms and conditions.
Article 21 – Applicable Law
These terms and conditions are governed by Belgian law.
Any disputes shall be submitted to the competent courts of Dendermonde/Ghent, Belgium.
Article 22 – Validity
If any provision of these terms and conditions is found to be invalid, the remaining provisions shall remain in full force and effect.
Article 23 – Platform Disclaimer
123event provides a technical platform for creating, managing and selling tickets for events.
123event does not guarantee any minimum level of ticket sales and is not responsible for the commercial success of an event.
The seller remains fully responsible for: promoting the event; attracting visitors; organising and executing the event.
123event exclusively provides the technical infrastructure for ticket sales and cannot be held liable for disappointing ticket sales, low visitor numbers or any other commercial results relating to an event.
